  • Proposed CBL Changes

    Constitution and Bylaw Change Proposal 1 Chad, Attached below you will find a rough edit of proposed changes to our PFFA constitution / Bylaws. Thanks, Bob These changes are intended to give you the intent and applicable sections of the proposed changes and may not include every section or detail needed to complete the change. The intent is being provided so that any other technical details throughout the document can be changed as needed to comply with the intent of the proposed changes. A brief summary of these changes are: 1. Change all voting to delegates in attendance at a meeting/convention opposed to one local one vote, per capita etc. This would apply to all elections including but not limited of PFFA Officers, procedures, and appointments to any state boards i.e. FRS, FETA ,State Supplemental Pay Board etc. 2. Adopting a uniform process to break ties using per capita or one local one vote.. 3. The language proposed is intended to be used at any meeting of the body called where elections or appointments are on the agenda opposed to convention only. To be entitled to seat delegates in convention, all affiliated Locals must have per capita tax paid up-to-date on full membership. No local shall be required to pay on more than 400 members nor shall any local be allowed to cast more than 400 of their Locals votes. All delegates must be in good standing with their respective Locals. Provided further that during any election of officers of this Association; and whenever a roll call vote is requested by at least four (4) Locals present, all such voting shall be required on the basis of (the majority of delegates in attendance vote the per capita tax paid) by each affiliated Local (1-man, 1-vote) which shall be determined by averaging the per capita tax paid by each respective Local during the last twelve (12) month period of the year ending December 31 preceding each annual convention of this association. Exceptions to this provision shall be the election of Vice-President At-Large and the Chairperson of the Human Relations Committee. VicePresident At-Large and the Chair of Human Relations shall be elected Statewide with each Local having one by the simple majority of delegates in attendance vote. District V-P’s are also exempt by being elected by the locals in their district voting by delegate strength Article IV Officers Section I Officers of this Association The officers of this Association shall consist of the following positions: PRESIDENT, SECRETARY-TREASURER, SEVEN (7) DISTRICT VICE-PRESIDENTS, ONE (1) DISTRICT VICE-PRESIDENT-AT-LARGE and the CHAIRPERSON of the HUMAN RELATIONS COMMITTEE. These Officers constitute the EXECUTIVE BOARD of this Association. The PFFA shall notify all Locals that are in good standing of all elections at least 90 days prior to the Annual Convention in which elections are to take place. A. All officers of this Association shall be elected Biennially by a majority vote of the Page 11 Delegates assembled in convention in the following manner. 1. The President and the Secretary Treasurer shall be elected statewide by delegates in attendance by per capita, secret ballot vote. 2. Vice-President At-Large shall be elected statewide, with each local having one vote by simple majority of delegates in attendance . 3. District Vice-Presidents shall be elected by the locals within their respective districts by delegate strength. Should a tie occur in the race for District Vice- President, the tie would be broken by each local in that district casting one vote. If a tie again occurs, then locals would vote Per Capita strength. 4. The Chairperson of the Human Relations Committee shall be a minority member of this Association in good standing. The Chairperson of Human Relations shall be elected statewide by simple majority votes of delegates in attendance. with each Local having one vote. B. Any officer or delegate present shall be eligible to hold office; and no elective officer of this Association shall be entitled to hold more than one office at a time. The District VicePresident must reside in the district he represents. C. All nominations shall be made from the convention floor in accordance with this Constitution. Officers will be given the oath of office by the person selected by the President immediately following the election. D. Should a member holding an office in the P.F.F.A. of Louisiana, who has been temporally called to active duty in the military reserves of the United States, during a period which falls on an election year convention, the affected officer shall submit a letter to the President or Secretary-Treasurer, expressing his or her intentions to accept nomination for re-election to the position which they presently hold. Section V Fire Fighter’s Retirement System The Executive Board shall elect from its members The delegates in attendance at a meeting of this association shall elect by simple majority of delegates in attendance at a meeting, two members of this association individual's to serve as this association’s representatives to the board of the Fire Fighters Retirement System. Should a vacancy occur for a position on the Fire Fighter’s Retirement System Board, due to resignation or expiration of term, such vacancy shall be advertised by email to each Local with at least a thirty-day notice. Any member of the Association shall be afforded the opportunity to submit the name of any qualified member of the Association for consideration to the Executive Board through their respective District Vice-President, Vice-President-at-Large or Chairperson of the Human Relations Committee. Section VI Supplemental Pay Board Representatives It shall be the policy of the Professional Fire Fighters Association of Louisiana The Executive Board shall select from its members The delegates in attendance at any meeting of this association, shall elect by simple majority of delegates in attendance at a meeting, the three members representing this organization on the State of Louisiana Firemen’s State Supplemental Pay Board. Should a vacancy occur for a position on the State of Louisiana Firemen’s State Supplemental Pay Board, due to resignation or expiration of term, such vacancy shall be advertised by email to each Local with at least a thirty-day notice. Any member of the Association shall be afforded the opportunity to submit the name of any qualified member of the Association for consideration to the Executive Board through their respective District Vice-President, Vice President-at-Large or Chairperson of the Human Relations Committee
